FPA Releases Updated TB215 For LPC Sprinkler Rules

The FPA has released a revised Technical Bulletin (TB) as part of its LPC Rules for Automatic Sprinkler Installations 2015, offering updated guidance on the correct storage of idle pallets within industry.

Published by the FPA, the LPC Rules for Automatic Sprinkler Installations 2015 is the UK's most significant sprinkler installation standard that incorporates the full BS EN 12845:2015+A1:2019 standard and related Technical Bulletins. The TB215: Sprinkler Protection of Idle Pallet Storage update for digital and print subscribers of the LPC Sprinkler Rules considers the rising number of timber and plastic pallets found, both internally and externally, in solid pile, racking, and incidental storage.

As the TB outlines, idle pallet storage represents one of the greatest challenges for sprinklers in terms of control or extinguishment of fires, particularly in the case of wooden pallets stacked in piles inside warehouses as they can dry out and ignite easily. With this in mind, TB215: 2024: 1 considers the risks posed by the storage of idle pallets and addresses them by providing an enhanced choice of solutions for contractors and their clients.

In particular, the detailed TB outlines the inherent fire risk posed by idle pallets, considers better pallet material classification, presents detailed guidance on storage arrangements, and offers greater storage options with respect to height and design density. Also included is a cross reference to TB234: Protection to High Hazard Storage (HHS) Configurations and information about sprinkler head requirements, Early Suppression Fast Response (ESFR) options, and confirmed water supply options.

The TB takes into account recent research that reviewed fire test information and other international standards to provide a more comprehensive and robust sprinkler protection option for idle pallet storage. NFCC Publishes Sprinkler Policy Statement

The National Fire Chiefs Council (NFCC) has called on the government for “greater inclusion” of automatic water suppression systems (AWSS) in the built environment, including schools, student accommodation, and care homes, irrespective of building height.

In a recently published policy statement, the NFCC highlighted the crucial role sprinklers play in the event of a fire, with research showing that they are “99% effective in extinguishing or controlling a fire and 94% reliable in their ability to operate across all building types”.

“Sprinklers save lives and reduce injuries. They have been used for over one hundred years and are consistently reliable, protect property, reduce the cost of repairs, and minimise the impact of fire on the environment. Sprinklers can also buy crucial additional time in firefighting operations which may mean that evacuations are not necessary in the first place,” the NFCC states.

With sprinkler requirements in other parts of the UK such as Wales and Scotland implemented more robustly, the NFCC admits that England’s current regulations “trail behind its neighbours”, calling on the government to “emulate the policies in the devolved governments to support unitary policy across nations by lowering or removing the acceptable height, floor area, or occupancy threshold dependent on building type”.

In particular, the NFCC has cited the following buildings where installation and retrofitting of sprinklers are most needed:

Care homes
Residential buildings
Schools
Car parks
Storage and warehouses
Hospitals

One of the recommendations the NFCC puts forward is the requirement for sprinklers to be installed in all new care homes irrespective of height, including those premises undergoing major refurbishment, extension, or alteration. Additionally, sprinklers should be retrofitted in all high-rise residential buildings over 18 metres (or at least 7 storeys) that are served by a single staircase. This also applies to those buildings that are over 11 metres in height on a “risk-assessed basis”.

Jonathan Dyson, NFCC Lead for Sprinklers and AWSS said :

“Sprinklers have been used for over a century and are consistently reliable at saving lives and reducing injuries. Analysis shows they’re 99% effective in extinguishing or controlling a fire. Sprinklers can buy crucial additional time for firefighting and can also protect property, reduce repair costs, and minimise the environmental impacts of fire.

“NFCC welcomed the lower height threshold for sprinkler installation in new residential buildings to 11 metres, but we remain concerned that there’s still no requirement to retrofit existing residential buildings with sprinklers. We’ve consistently urged the Government to make it a requirement to retrofit all existing residential buildings over 11 metres on a risk-assessed basis.”

The recommendations also extend to all new schools, all new student accommodation, and all existing schools and student accommodation undergoing major refurbishment regardless of height.

NFCC Chair, Mark Hardingham said: “Thankfully, deaths and injuries in school fires are rare. However, it’s important that we protect schools as they are vital community assets. School fires can be devastating, and the use of sprinklers is proven to not only minimise the disruption to a pupil’s education but also the impact on their family and the community.

“NFCC have consistently called for sprinklers to be mandated in all new and refurbished school buildings in England, which would provide the same level of protection as schools in the rest of the UK.

“We also have serious concerns about fire safety in care homes. Sprinklers are critical to protecting vulnerable residents as well as employees. Installing sprinklers in care homes would reduce the likelihood of a fire spreading beyond the room in which it originated. This buys time for evacuation and firefighting and can reduce the need for vulnerable residents to be moved.

“We welcomed the Government’s proposal requiring sprinklers be installed in all new care homes regardless of height. However, it must go further to include existing care homes undergoing refurbishment.”

Notably, the body recognises the use of watermist systems as an alternative to AWSS, however, it adds that such systems “cannot be used interchangeably” with sprinkler systems:

“Watermist systems are an engineered solution for specific applications and strengthened test protocols are required to support their use”.

Government Publishes Updated Guidance On Second Staircases

The Department for Levelling Up, Housing, and Communities (DLUHC) has updated its guidance calling for second staircases in all new tall residential buildings over 18 metres in height.

Published on 29 March 2024, the technical guidance sees amendments to Approved Document B (ADB) Volume 1 (dwellings) and Volume 2 (buildings other than dwellings), with changes expected to take effect on 30 September 2026 in England. DLUHC states that the subsequent transition period will “provide clarity for developers during a difficult economic climate” and that projects previously held up at the planning stage will now be able to “go ahead with certainty”.

As detailed in the government document, the changes focus on the following fire safety provisions:

A new recommendation for more than one common stair to be provided in blocks of flats with a storey 18m or more in height
Building design provisions to support the use of evacuation lifts in blocks of flats.

The technical guidance pays particular focus to the designs for horizontal escape and vertical escape, along with the design and construction of common stairs. For instance, it specifies that interlocked stairs are considered a “single escape route” and “do not constitute an alternative means of escape”. As Inside Housing reports , the guidance also makes clear that evacuation lifts will “not be a requirement”.

Minister for Housing, Lee Rowley said the changes will offer “clarity for developers and ensure both new and existing buildings provide safe and secure homes for all residents”. Notably, DLUHC is expected to publish a response to recommendations for personal emergency evacuation plans in “due course”, as well as considering fire safety reforms for existing tall buildings.

“A second staircase will facilitate evacuation if a ‘Stay Put’ recommendation needs to be overridden. The provision of a firefighting shaft, alongside the inclusion of a protected staircase is expected as well as compliance with all other provisions outlined in Approved Document B.

“The updated guidance will not call for evacuation lifts as a matter of course and will provide developers with the clarity they need to progress developments. The design of each high-rise building will continue to receive individual scrutiny from experts, now via the Building Safety Regulator. The fire safety design for any higher risk building above 18m will be subject to review at Planning Gateway One by fire safety professionals and by a multi-disciplinary team at Gateway Two.”

As previously reported by the FPA, requirements for a second staircase in new high-rise residential buildings were first proposed in a public consultation at the end of 2022. Of the responses received , 65% agreed that ADB should include a maximum threshold for the provision of a single staircase in multioccupancy residential buildings. DLUHC later confirmed that the government would be “implementing a second staircase only solution”, with the Secretary of State for Levelling Up, Housing, and Communities, Michael Gove, announcing in July 2023 that the threshold for this requirement would be 18 metres. In October 2023, transitional arrangements, including a 30-month “grace period”, were introduced .

However, fears regarding construction delays and additional build costs brought about by the new requirement have been widely shared throughout the industry, including The Housing Forum .

As part of the consultation outcome, DLUHC stated that it recognised the concerns raised by respondents over “cost and space impacts” and the “effect the proposal could have on housing supply”, but it reiterated that the introduction of a second staircase only solution would cause the “least amount of cost impact to housing supply”.

“It is customary for changes to building regulations to be accompanied by a transition period to provide clarity to building control bodies and those commissioning, designing, and carrying out the building work. It also reduces the risk to developers being impacted by changes to requirements part way through the design and construction process.

“…With these transitional arrangements, we will ensure that projects that already have planning permission with a single staircase can continue without further delay. This reflects the fact that the introduction of a second staircase is part of a gradual evolution of safety standards within buildings.”

FPA’s Dr. Gavin Dunn Draws Focus to the Importance of Net Zero Goals in Fire Safety

With his background as a chartered building engineer, newly appointed FPA Managing Director Dr Gavin Dunn has highlighted the challenges being posed to the built environment sector by the need to address climate change.

Speaking to Fire & Risk Management, he said: “As we drive towards net zero, the imperative to decarbonise is increasingly driving business decisions, and this holds true for the built environment sector. This focus on the environmental impact and energy performance of the buildings we live and work in are a step change from the past, and with this comes a changing risk profile that the fire safety sector simply must be aware of.

“The introduction of new practices and materials to meet net zero goals mean taking risks that have not been taken before. The go-to technologies for decarbonisation tend to burn well – new high-performance insulation materials, lightweight construction technologies including a wider use of timber, and high-performance building energy systems – such as solar panels, thermal or battery storage, and the much wider use heat pumps and refrigeration technology. Should there be a fire event, having this technology present in a building not only increases the risk of fire, but brings further issues around the release of potential toxic effluents. Any fire will release the embodied carbon of that building into the atmosphere, therefore fire safety is a critical part of sustainability as well as safety.

“The importance of enacting net zero plans within the built environment is now well known and we have the knowledge as to how this can be achieved. It is vital, however, that we now learn how to do this safely and efficiently.”

As part of the FPA’s remit to improve the fire safety awareness of this important topic, Gavin will be opening this year’s FPA Spring Seminar on ‘Fire Safety and Sustainability of the Built Environment’ taking place on Wednesday 17 April at Chicago Booth’s London Conference Centre and online. Government Publishes Evacuation Guidelines for Fire and Rescue Services

The Home Office has published a new document outlining its research-backed guidelines for fire and rescue services during high-rise evacuations.

Published on 5 February 2024, and to support the operational practices of fire and rescue services during a full or partial evacuation from high-rise residential buildings, nine national guidelines have been specified by the government:

Building height (timing of evacuation)
Staircases (timing of evacuation)
Evacuation alarm systems versus door-knocking
Emergency evacuation methods for residents
Evacuation movement and vulnerable residents
Undertaking evacuations of vulnerable residents
Information on vulnerable residents
Evacuees’ behaviour
Information sharing amongst residents.

The above guidelines aim to make fire and rescue services aware of various changeable factors, such as timing and movement, when carrying out resident evacuations. For instance, the document states that “total evacuation time in the stairwell should not be derived from travel distance alone” as “doubling the building height does not necessarily double the total evacuation time”. It also comments on the potential advantage of two staircases in an evacuation scenario compared to one, stating that “there is a benefit of having an unobstructed staircase for the sole use of evacuation in a building during a fire incident”.

The guidelines are in response to the Grenfell Tower Inquiry (Phase 1) recommendation that called for the government to “develop national guidelines for carrying out partial or total evacuations of high-rise residential buildings”, with such guidelines to include the “means of protecting fire exit routes and procedures for evacuating persons who are unable to use the stairs in an emergency, or who may require assistance (such as disabled people, those with cognitive impairment, older people and young children)”.

In particular, the government document highlights additional care and assistance for vulnerable residents and a better understanding of resident behaviour during fire incidents, which fire and rescue services should be mindful of.

“It should also not be assumed that residents will automatically be aware of what to do or follow signage in place and may need clear instructions to support their understanding of the incident and the required response,” the guidance states.

The newly published guidelines have been influenced by recent research, including a rapid evidence review report on evacuations for high-rise residential buildings that was published in November 2022 and a study by the University of Edinburgh on resident response to fire incidents in high-rise buildings from June 2023. It also draws on information gathered from previous consultations on PEEPs and EEIS.

The document is also heavily supported by research and testing carried out by the University of Central Lancashire (UCLan), which analysed strategies for the evacuation of occupants from high-rise residential buildings involved in a fire. As part of its study, UCLan performed a series of live operational testing strategies using fire and rescue services staff and volunteers. They included:

a full simultaneous evacuation using an evacuation alert system (single staircase)
a full evacuation with door-knocking alerts from the bottom to the top of the building, without an evacuation alert system (single staircase)
a full evacuation using an evacuation alert system (single staircase): phased bottom-up from above the fire
a full evacuation using an evacuation alert system (single staircase): phased top-down from above the fire
a full simultaneous evacuation using an evacuation alert system with two staircases.

The Home Office was able to derive several research questions from UCLan’s testing methodology, including which strategies were likely to lead to the fastest evacuation of a high-rise residential building, to what extent each of the evacuation strategies led to congestion in stairwells, what impact evacuees with impairments had on evacuations, and any further factors that might affect live evacuations from high-rise residential buildings.

Fire Suppression Water Recycling Campaign Launched

A specialist UK provider in the design and maintenance of active fire suppression systems has launched a campaign to help businesses recycle and repurpose water used for necessary fire testing.

Fire suppression systems are recognised as being the most effective way to control fire and help prevent its spread, with fire safety regulations specifying that businesses test their fire suppression systems every week to ensure their effectiveness. As a result, businesses carrying out vital testing on their fire suppression systems need to use billions of litres of drinking water each year.

At present, there is no requirement to capture or repurpose this water, and in an effort to improve sustainability, Alpine Fire has partnered with the London School of Architecture (LSA), whose students are working on a project to design a better system that will capture this water and allow its sustainable reuse.

As Alpine Fire CEO Steven Nanda explains, making vital fire testing measures more sustainable is a key priority: “Water usage in the UK’s fire suppression systems has been overlooked so far, and our customers are under pressure to address every aspect of their sustainability. We are committed to leading the campaign for change.”

Technical Director for the FPA, George Edwardes responded to the initiative, saying: “The testing of fire suppression systems is a vital element of life safety – we are already aware of the impact of failing to conduct these critical tests on a regular basis. Fire safety should however also be sustainable wherever possible, and we welcome this initiative to improve the effectiveness of recycling water.”

The campaign has already engaged with former DEFRA Secretary George Eustice MP, BAFSA, and is working with DEFRA to explore how changes can be addressed.

“We are hugely encouraged by our engagement with DEFRA and feel confident that together we can work towards a change in regulation for new builds as well as retrofitting existing buildings,” Steven adds.

Commenting on the campaign, George Eustice noted that with water scarcity being a real and live issue in the UK, this initiative will help bolster water reuse. Neal Shasore, CEO of LSA added: “We are delighted to be part of this worthwhile sustainability initiative and are already inspired by the work our students have produced in response to this challenge.”

In addition, and by way of offsetting the millions of litres of water that they use each year, Alpine Fire has embarked on a multi-year programme of dam restoration with the Lake District National Park. The first project will see the dam at Throng Moss Tarn restored, a critical haven for wildlife and an important reserve of water for use against wildfires in the area.

Gavin Capstick of the Lake District National Park said: “Water scarcity is a very real issue for the UK’s National Parks, and as England’s biggest park, the Lake District sees the effects more than most. We are delighted to be working with Alpine Fire to restore Throng Moss Tarn for wildlife and as a strategic water reserve.”

House Of Lords Debate The Current Fire Safety Regulatory Landscape

On 14 December 2023, members of the House of Lords debated the current state of England’s fire safety regulations, putting forward the case for a new integrated review and update of fire safety guidance.

The debate saw key representation from the All-Party Parliamentary Fire Safety and Rescue Group (APPG) and the Local Government Association (LGA), with Lord Goddard of Stockport, an APPG member and part of the Greater Manchester Fire and Rescue Authority, speaking on the implementation of the new building safety regime in light of the Grenfell Tower fire, the newly appointed powers of the Building Safety Regulator (BSR), and the further regulations that could be expected in April 2024. He noted the lack of clarity around certain fire safety elements, which came down to “fragmentation” and the continued “overlap of grey areas in government departments”, calling for greater integration in the government.

The government’s prioritisation for fire safety in buildings over 18 metres, which did not outline similar measures for schools, new care homes, or hospitals, came in for criticism. Lord Coaker noted that although sprinklers were a requirement in certain buildings, “many of us find it very difficult to understand why you would not put sprinklers in new care homes, hospitals, or schools.

“What is the Government’s rationale for their policy on sprinklers in both new and old buildings?”

The debate also considered the increasing resource and financial pressures faced by local councils to implement fire safety measures under the BSR’s new regime. Lord Tope stated: “Local authorities are facing an increasingly complex regulatory environment, with a multitude of changes and different regulators. Alignment between regulatory bodies must be central to developing new regulatory practice and requirements.

“The building safety regulator charging regime will put significant additional financial pressure on local authorities, particularly those with a high number of complex buildings.”

A key part of the debate was also dedicated to the “emerging, life-threatening danger” of lithium-ion batteries, with Baroness Brinton calling for the registration of such batteries. She also raised the issue of out-of-date regulations, stating that “There is no doubt that some progress has been made, but as we are already hearing in this debate, there are still some gaping holes.

“One of the most urgent things that has not been discussed so far is the updating of Approved Document B, part of the building regulations guidance. It is very out of date. Not one of the government fire-risk assessment guides has been revised since its publication in 2006.”

The discussion of additional fire safety concerns not covered by the government’s latest regulations, such as compartmentation, saw Lord Hendy state: “The whole issue of compartmentation, as a building principle, needs to be looked at again, because it is not good enough to simply have a guarantee that the compartment will withstand fire when it is built. Since the building will be standing for the next 50 or 100 years, there has got to be some guarantee, or some means adopted, to check that the compartment will still withstand fire over the intervening years.”

Lord Goddard, who put forward the debate, remarked: “History tells us that with fire, legislation normally follows disasters and subsequent inquiries bring recommendations from the Woolworths fire in Manchester, the King’s Cross disaster, Grenfell Tower, and numerous train accidents. This cannot be a coherent way to determine fire safety policy. We must integrate fire in one place, where all the standards and policies will be made and where one person will be held accountable. It needs specialist advisers who will not necessarily tell the Minister what he wants to hear, but what he needs to hear.”

Baroness Brinton noted that even with the present challenges, many fire safety professionals were eager for better engagement and dialogue with the government regarding fire safety matters. Mentioning her recent attendance at the Fire Conference 2023, she told members:

“Let me end on a positive note. At the Fire Conference 2023, which I attended, I heard very encouraging dialogues between firefighters, those making provision in the construction industry, and specialist fire services. All of them were saying that the Government’s approach at the moment is too complex and too slow.”

Addressing the queries from the floor, Lord Gascoigne added: “The reforms we have delivered will take time to fully implement and take hold.

“I assure the House of the Government’s enduring commitment to improved fire safety, as we seek to ensure everyone is safe, and feels safe, in the buildings in which they live and work.”

Competency & Capacity Risks From New Building Regulations Highlighted

Fire safety professionals are suffering from an ever-increasing skills gap as changes to Building Regulations come into force, experts have warned.

During a panel discussion at London Build 2023, Laing O'Rourke’s Systems and Assurance Leader for Passive Fire Protection Nick Pickles stated that with the advent of the new building safety regime, where competency is a key factor, gaps in education and training could put additional pressure on fire safety professionals.

The session, which covered enhancing building safety through standardising processes in fire stopping, discussed some of the current challenges faced by professionals in the industry, particularly the growing divide between those who were able to show evidence of competency in their roles and those who were not. With delays in training, education, and the “upskilling of the profession” coupled with further changes to Building Regulations, fewer professional people were working in the sector who could be deemed competent, resulting in safety risks.

As reported by Construction News, Nick said: “I think the risk is that the people who are deemed competent, whether they are or not, will end up overloaded.

“There’s a huge amount of work that needs to be done. And it will either be done by people who are not deemed competent, or you will overload the people who are [and these] people become burnt out.

“And that’s when people make mistakes, they take their eye off the ball. If you do that once... we’re not talking about a leaky pipe, we’re talking about life safety.”

The panel agreed that better collaboration and the sharing of information could ensure professionals were kept up to date with the complexity of fire-critical products in construction, for example. With the technical specifications for such products running into hundreds of pages, Paul McSoley, Technical Compliance Director at Mace, argued that it would be difficult to expect one person to show the necessary competency for all aspects of building design: “I think the expectation was that architects will be able to do all of this, but they can’t do it unless other actors are passing that information across a common platform that you can actually see.”

Also from Laing O’Rourke, Richard Fordyce added that a separate “construction discipline” was needed that could cover the “specification and selection of fire-safety-critical building products”, with collaboration between different sectors to “define what this new discipline is going to look like”.

Many of the changes introduced by Building Regulations etc. (Amendment) (England) Regulations 2023 have directly impacted “principal duty holders”, including architects and designers, signifying greater demand for accountability of compliance with building regulations by the government.

The October 2023 amendments also introduced additional requirements for responsible persons of higher-risk residential buildings, with the necessity of hiring competent professionals, such as fire risk assessors, becoming paramount.

As previously reported by the FPA, in its updated guidance, the Home Office stated: “There is also a legislative requirement that, where the Responsible Person appoints a person to make or review the fire risk assessment, they must be competent. This legislative requirement will be brought into force at a later date, and we will provide relevant guidance in that regard ahead of the commencement date.”

Higher-Risk Building Control Process Update Released by Government

The Department for Levelling Up, Housing, and Communities (DLUHC) has produced a circular letter for England’s building control bodies informing them of changes to the building control process for higher-risk buildings.

Published on 31 October and addressed to Heads of Building Control, Approved Inspectors, and Fire and Rescue Authorities, the comprehensive letter outlines the changes that came into effect, as of 1 October 2023, to the following regulations in England:

The Building (Higher-Risk Buildings Procedures) (England) Regulations 2023
The Building Regulations etc. (Amendment) (England) Regulations 2023
The Building (Approved Inspectors etc. and Review of Decisions) (England) Regulations 2023
The Building Safety Act 2022 (Consequential Amendments etc.) Regulations 2023
The Building Act 1984 (Commencement No. 3) (England) Order 2023
The Building Safety Act 2022 (Commencement No. 5 and Transitional Provisions) Regulations 2023.

Penned by the Deputy Director of Reform Policy, Legislation, and Sponsorship for the Safer Greener Buildings Group at DLUHC, Camilla Sheldon, the letter offers further detail on the changes to the building control regime in England. Specifically, it covers the “ technical detail underpinning the new, more stringent regime for the design and construction of higher-risk buildings and building work carried out in these buildings, wider changes to the building regulations for all buildings, and the creation of a regulated building control profession ”.

Briefly, in terms of updated building control processes for higher-risk buildings, the letter considers transitional arrangements, all building work overseen by local authorities and approved inspectors, regulator notices, duty holder duties and competence, changes to enforcement for all buildings, and changes to the approved inspectors building control regime for non-higher-risk buildings.

DLUHC makes clear that while the letter provides guidance to building control bodies on the new building control regime, it is up to those bodies to “ satisfy themselves that they understand the new regulatory changes ”.

“ Together these regulations will fundamentally reform the way buildings are designed and constructed, and how building work is carried out, delivering lasting building safety reform for generations to come ,” Camilla writes.

FSF To Develop British Standard For Fire Risk Assessors

Following the release of its Industry Benchmark Standard for Fire Risk Assessors, the Fire Sector Federation (FSF) has confirmed its plans to develop the framework into a British Standard.

Published in December 2022 and created in conjunction with the Fire Risk Assessors Working Group, the purpose of the FSF document is to help improve assessor competency and understanding when it comes to fire risk. During its launch, the benchmark standard was widely welcomed by industry professionals, who agreed that the document both complemented and expanded previous work carried out by the Federation. Specifically, the standard set out key competency requirements for fire risk assessors, “progressively raising competency across three tiers to meet more and more complex risks”.

FSF has since confirmed that the benchmark standard will begin its development process to become a British Standard, as part of the BS 8670 Built Environment – Core criteria for building safety in competence frameworks. As noted by the working group, the route to demonstrate competency as a fire risk assessor is now much clearer, with individuals being required to “show conformity to regulated standards”.

FSF adds that the members creating the benchmark standard also recognised the “importance of facilitating transitional arrangements for experienced workers holding existing appropriate occupational qualifications and experience”. Thus, the design and structure of the standard is “fully adaptable to assist this transition given there are many existing FSO-proficient fire risk assessment processes to incorporate”.

Dennis Davis, Director of Competency at the Fire Sector Federation, tells the FPA:

“Our aim throughout the process of development of the Benchmark Standard has been to raise the professional status of the important work undertaken by fire risk assessors.

“The route to demonstrating competency is now much clearer but we also wish to continue to engage with all those proficient assessors, operating without formal or recognised competency assurances, to help them become recognised by seeking appropriate independent accreditation.”

Important Fire Safety Regulations Come Into Force

As of 1 October 2023, new fire safety guidance and amendments to Section 156 of the Building Safety Act 2022 (BSA) of the Regulatory Reform (Fire Safety) Order 2005 (FSO) will come into force.

In March 2023, the Home Office outlined its plans for the new fire safety legislation, which falls under Phase 3 of its fire safety reform programme. As previously reported by the FPA, the changes directly apply to responsible persons (RPs) of high-rise residential buildings and see requirements for more transparent recording and documenting and higher levels of information sharing.

Responsible persons

Specifically, Phase 3 looks to improve cooperation and coordination between RPs, ensure a continual record of shareable fire safety information throughout a building’s lifespan, make it easier for enforcement authorities to take action against non-compliance, and ensure residents have access to comprehensive information about fire safety in their buildings.

In its guidance, the Home Office adds: “There is also a legislative requirement that, where the Responsible Person appoints a person to make or review the fire risk assessment, they must be competent. This legislative requirement will be brought into force at a later date, and we will provide relevant guidance in that regard ahead of the commencement date.

“In the meantime, if you do appoint a fire risk assessor our recommendation is that you ensure they are competent to do so, in terms of having sufficient training and experience or knowledge and other qualities. It remains the case that the Responsible Person has a duty to make sure that a suitable and sufficient fire risk assessment is completed.”

High-rise building registrations

1 October also marks the date on which high-rise residential buildings must be registered with the Building Safety Regulator (BSR). Since the registration scheme opened in April 2023, the Health and Safety Executive (HSE) revealed that 10,080 applications had been started. According to BSR data, approximately 12,500 high-risk residential buildings, which are over 18 metres in height, will need to be registered.

As reported by Building, over 2,000 high-rise building applications remain outstanding in the lead up to the registration deadline. On 20 September, the HSE sent out a reminder that it was a “legal duty” to register high-rise residential buildings. HSE states:

“It will be a criminal offence for any qualifying building not to be registered with the new regulator after 1 October 2023. Registration opened in April 2023.

“Those responsible for high-rise buildings not registered by the deadline could face significant sanctions, including prosecution.”

Deputy Chief Inspector of Buildings at BSR, Chris Griffin-McTiernan said: “I would encourage any organisation that has not registered their high-rise building, to do so now. There is guidance available to help you comply with the law.

“The creation of this register is a major step forward in terms of building safety in England. Residents themselves will soon have access to the register. This new transparency will shift power towards those who live in these buildings. Residents deserve the better oversight we will be able to provide with the register.”

The Cost of a Business Fire

Fires can have devastating consequences for businesses, both in terms of property damage and human casualties.

It’s hard to determine the true cost a fire has inflicted upon a business as there are many factors beyond simply repairing damages and replacing equipment. Depending on factors such as the severity of the fire and the type of business, the cost of a fire can be significant, both in terms of immediate expenses and long-term effects on the business’s operations.

Immediate costs of a business fire

The immediate costs of a business fire can be substantial, these can include:

Damage to property & equipment: Whenever there is a fire it’s to be expected that there will be some damage to the property and perhaps some equipment, however depending on the location and severity of the fire it can be quite substantial. If the structure of the building is weakened then it could require special contractors resulting in further costs and more time before that building can be utilised. In terms of equipment it can range from minor replaceable items to key, expensive pieces of equipment required for many business operations.
Interruptions to business operations: A fire within a business can cause anywhere from minor disruptions you are able to work around, to major interruptions that can potentially result in temporary or even permanent shut downs. Minor issues may not affect business operations, however more severe fire damage can lead to things such as reduced functionality, limited production, impacts on client services or worse cases, temporary to permanent closures.
Impacted employees: whether there are injuries or not, employees within the business may be affected in various ways. If anyone sustained injuries from the fire or potentially from the smoke produced by the fire, then they may require time off until they have recovered and are able to return to work. On the other hand, if they weren’t injured but their work station/area of work was badly damaged then it would need to be decided what they will do either until such an area is repaired or if they might need assigning a new role if possible.

Long term effects of a business fire

Additionally, there can also be long-term effects to the business which can affect operations, these can include:

Loss of reputation: If a business fire impacts its operations, it has the potential to affect client orders or services. Some clients may see this as the business being unreliable and may look elsewhere in the future. The same can also be said if the business had to close for any length of time due to damages, the client may end up looking elsewhere for any products or services.
Loss of data: A large number of businesses store client/customer data for various reasons. If a business happened to not be using cloud storage or offsite backups and a fire destroyed where that data was being stored, this could have a huge impact to the business’ operations for its clients/customers. This could include a number of setbacks due to re-establishing connections and redoing work.
Impact upon employees: Following a fire employees may have a lower morale from experiencing the event, this could affect how the business is run. Also, if employees were injured or if their work area was damaged they may be left unable to do their job which could lead to job losses.

Reducing the risk of a business fire

While it is impossible to completely eliminate the risk of a business fire, there are a number of options available to monitor and reduce potential risks whilst also minimising the damage if a fire were to occur. Here are a number of ways to reduce and manage fire risks:

Fire detection and suppressive equipment: Ensuring you have sufficient fire detection and suppressive equipment in place and keeping everything in good working condition is not only a considerably important part of your fire safety but it is also a requirement under various regulations.
Train staff on fire safety procedures: Keeping all members of staff trained and up to date on the usage of fire safety equipment and procedures in place in the event of a fire is key to limiting injuries and minor damages.
Carry out frequent fire risk assessments: Carrying out regularly scheduled fire risk assessments is an effective way to identify potential fire risks and put actions in place to prevent them from occurring wherever possible.

What You Need to Know About The Fire Safety Act 2021

The Fire Safety Act 2021 is an Act of Parliament that updates the Regulatory Reform (Fire Safety) Order 2005 – the FSO.

It brings some important changes to the responsibilities of landlords, property managers and other ‘responsible people’.

The amendments also make it easier for enforcement action to be taken against the Responsible Person. Therefore, it’s important to understand just what you, as a responsible person, are required to do for the safety of your tenants.

The background of the Fire Safety Act 2021

In March 2020 a Bill was introduced to Parliament following the tragedy of the 2017 Grenfell Tower fire, amending the existing FSO. The amendments are intended to make it clear who is responsible for managing and improving fire safety in the different areas of houses in multiple occupancy (HMO).

The Bill received Royal Assent on 29 April 2021 and was named the Fire Safety Act 2021 (FSA). The law applies to England and Wales; Scotland and Northern Ireland have separate fire safety regulations.

The key provisions of The Fire Safety Act 2021

The amendments address two key areas of the concern. These are:

The structure of a building including external walls and any shared common areas. External walls include doors and windows, as well as anything attached to them such as balconies, insulation or cladding.
All doors that separate the individual flats from communal areas. These should be the appropriate fire doors.

The FSA applies to all houses in multiple occupancy, regardless of height. This means it affects a house converted to two flats as well as high rise apartment blocks.

Who is responsible for implementing the FSA?

The FSA identifies the ‘Responsible Person’ of a premises as the person who has control of it. That may include the building owner, landlords or property management agencies. The Responsible Person has a duty to undertake fire assessments and manage any risks in the property.

What do they need to do now?

In view of the changes brought by the FSA, the Responsible Person should review and update the fire safety processes accordingly. That means that, in addition to existing responsibilities, they are now required to assess fire risks posed by the structure and external walls of their premises, and the individual doors that separate domestic premises from common areas.

The Responsible Person will need to manage and reduce any fire risks in those areas. While remedial works are ongoing, the Responsible Person may need to introduce temporary safety measures.

To help with this process, Section 3 of the Act will include risk-based guidance to help the Responsible Person to comply with their duties. It will also provide a benchmark to identify where they have been non-compliant. This risk-based guidance has not yet been released by the government.

Who enforces the Act?

The FSA is enforced by fire and rescue authorities. Now, with the amendments and clarification provided by the FSA, they will be able to better identify the Responsible Person and take enforcement action against the Responsible Person for non-compliance. This may also lead to fines and/or prosecution.

Who is responsible for costs?

As a result of the changes to the FSA, it is likely that there will be remedial works required to many HMOs to bring them up to the required fire safety standards. However, The FSA does not address the issue of who will be paying for those costs.

A proposal was put forward to prevent the building owners from passing those costs on to the leaseholders. This was rejected by the government. Instead, they announced that leaseholders in buildings over 18 metres high would not bear the costs of replacing dangerous cladding and they are in the process of providing some funding. However, the expected funding is considered to be insufficient to the huge sums of money that will be required.

As it stands, leaseholders currently may face the brunt of costs to improve internal fire safety improvements. They are also likely to be affected by higher insurance and so on.

The future for fire safety regulations

There is currently a further Bill passing through Parliament – The Building Safety Bill. This is designed to clarify responsibilities for fire safety throughout the design and construction of buildings within its scope. However, this does not help leaseholders currently in buildings that fail to meet FSA standards, and who now face potentially huge costs to improve them.

The FSA also has a further impact by adding to the responsibilities of surveyors and fire risk assessors. However, there is already a lack of qualified surveyors to conduct fire safety surveys, and a lack of processional indemnity insurance to cover their new requirements.

What landlords, building owners and property managers should do now?

The Fire Safety Act 2021 has clearly placed additional responsibilities on the Responsible Person. While the date that the FSA will come into force has not yet been set, it is coming. It would therefore be best to get ahead and begin your risk assessments now.

If you are a landlord, building owner or property manager of an HMO, you should clearly establish who is the Responsible Person.
If you do not already know, find out what materials were used in the structure of your property.
Make sure the doors between individual premises and common areas are compliant and in good condition.
Review and update your fire safety processes.
If necessary, make sure you obtain advice and support from fire safety experts.
